Townloop Terms of Use

These Terms of Use (“Terms”) govern your use of the Townloop website and mobile application (together, the “Services”).
Townloop is operated by Go Social Industries Pty Ltd trading as Townloop (ACN 694 270 516) (“Townloop”, “we”, “us” or “our”).
By accessing or using Townloop, you agree to these Terms.
If you do not agree with these Terms, you must not use the Services.
1. About Townloop
Townloop is a local event discovery and event-hosting platform.
Townloop allows users to:
discover nearby events and activities
browse events by category, date and distance
use map and adjustable search-radius features
follow events and Hosts
switch between user and Host functionality
create and share local events
edit and manage events.
Townloop supports local event discovery for communities, individuals, community groups, venues, organisations and businesses.
2. Eligibility
You must be 18 years or older to create or use a Townloop account.
By creating an account, you confirm that you are at least 18 years old and legally capable of agreeing to these Terms.
Accounts created by people under 18 may be removed.
3. Your Account
Some Townloop features require an account.
You agree to:
provide accurate information
keep account information reasonably up to date
keep your password and login credentials secure
not provide access to your account to an unauthorised person
notify Townloop if you believe your account has been compromised.
You are responsible for activity conducted through your account unless the activity results from circumstances reasonably outside your control.
4. Discovering Local Events
Townloop helps users discover events using information including:
location
categories
dates
distance
search radius
event information supplied by Hosts.
Townloop does not guarantee that every event taking place in a particular location appears on the platform.
Search results vary according to available listings, your location and your selected preferences.
5. Location Services
Townloop uses precise device location, with your permission, to support local discovery features.
These features include:
nearby event discovery
maps
distance information
adjustable search radius.
Location information and calculated distances may not always be exact.
Townloop location features must not be relied upon for emergency, safety-critical or navigation purposes.
6. Host Mode
Townloop users can switch to Host mode to create and manage events.
Host mode allows Hosts to:
create events
publish event information
add event locations
add images and descriptions
edit event information
manage event listings
share events with the Townloop community.
Using Host mode does not mean that Townloop endorses, verifies or approves a Host or event unless Townloop expressly states otherwise.
7. Host Responsibilities
If you create or manage an event through Townloop, you are responsible for your event and its listing.
You must ensure that:
event information is accurate
dates and times are correct
event locations are accurate
descriptions are not misleading
you have permission or authority to organise or promote the event
required permits, licences, approvals and insurance are held where applicable
your event complies with applicable laws
you have the right to use photographs, logos, text and other uploaded content
material changes and cancellations are updated promptly.
You must not falsely claim sponsorship, partnership, endorsement or affiliation with another person or organisation.
8. Event Information
Townloop provides a platform through which Hosts publish event information.
Unless Townloop expressly states otherwise, Townloop is not the organiser, operator or provider of third-party events displayed through the Services.
We do not guarantee:
that an event takes place
that an event is not cancelled, postponed or relocated
that every listing is complete
the quality of an event
the conduct of a Host
the conduct of attendees
the suitability of an event for a particular user.
Users should check important details with the relevant Host or venue before attending.
9. Event Changes and Cancellations
Hosts are responsible for keeping their event information current.
Townloop is not responsible for loss, cost or inconvenience arising from:
cancellation
postponement
relocation
changes to an event
inaccurate information supplied by a Host,
except where liability cannot lawfully be excluded.
10. Tickets, Payments and Transactions
Townloop does not process ticket sales, event payments or financial transactions through the Services.
Townloop is not a ticket seller, payment processor or merchant for events listed on the platform.
If a Host links to an external ticketing, payment or booking service, that transaction occurs directly through the relevant third party and is governed by that third party’s terms and privacy practices.
Townloop is not responsible for external transactions that it does not process or control.
11. User and Host Content
Townloop users and Hosts may upload or publish content including:
event information
images
photographs
profile information
venue information
descriptions
other materials.
You retain ownership of content that you own.
By uploading content to Townloop, you grant Townloop a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format and display that content as reasonably necessary to provide and operate the Services.
This licence does not transfer ownership of your content to Townloop.
12. Content Standards
You must not publish or upload content that:
is unlawful
is fraudulent or deliberately misleading
infringes copyright, trademark or other intellectual property rights
violates another person’s privacy
contains malicious software
promotes unlawful activities
seriously threatens, abuses or harasses another person
contains unlawful discriminatory material
impersonates another person or organisation
falsely represents an affiliation or endorsement
is otherwise inconsistent with the intended use of Townloop.
Townloop may remove or restrict content that reasonably appears to violate these Terms or applicable law.
13. Images and Information About Other People
You are responsible for content you upload.
If you upload photographs, video or personal information relating to another person, you must have the right or permission to use and publish that material.
Do not publish another person’s sensitive or private information without their permission.
14. Reporting Events or Content
Users can contact Townloop regarding content, events or accounts that appear to violate these Terms.
Reports can be sent to:
Townloop may review reported content and take appropriate action, including:
removing content
restricting content
suspending an account
terminating an account
referring serious matters to relevant authorities.
15. Safety
Townloop helps people discover events but does not supervise third-party events or interactions between attendees and Hosts.
You are responsible for assessing whether an event is appropriate for you.
Relevant considerations may include:
location
venue
accessibility
transport
weather
physical activity
equipment requirements
event conditions
personal safety.
You participate in third-party events at your own discretion.
16. Third-Party Services and Links
Townloop may link to third-party services such as:
event websites
venue websites
maps
social media
external booking services
Apple App Store
Google Play.
Third-party services operate independently under their own terms and privacy policies.
Townloop is not responsible for third-party services that it does not operate or control.
17. Intellectual Property
Townloop, its software, branding, logos, website design and original platform materials are owned by or licensed to Go Social Industries Pty Ltd.
These Terms do not transfer ownership of Townloop intellectual property to you.
You must not, except where permitted by law:
copy Townloop software
reproduce Townloop branding
modify or distribute Townloop platform materials
reverse engineer the Services
commercially exploit Townloop intellectual property without permission.
User-created content remains subject to Section 11 of these Terms.
18. Acceptable Use
You must not:
use Townloop for unlawful activity
create fake or deliberately misleading events
create fraudulent accounts
attempt unauthorised access to another account
interfere with Townloop security
interfere with platform operation
introduce malware or harmful code
scrape or systematically extract Townloop data without permission
use automated systems in a way that places unreasonable load on Townloop
manipulate platform activity
spam users or Hosts
misuse location or personal information obtained through Townloop.
19. Suspension and Termination
Townloop may suspend, restrict or terminate an account where there are reasonable grounds to believe that:
these Terms have been breached
fraudulent activity is occurring
illegal activity is occurring
an account creates a security or safety risk
action is necessary to protect users or Townloop
applicable law requires the action.
You may stop using Townloop at any time.

20. Availability
Townloop aims to provide reliable Services, but continuous or error-free availability is not guaranteed.
Access may occasionally be affected by:
maintenance
technical problems
network failures
third-party service failures
software updates
circumstances outside Townloop’s reasonable control.
21. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
Where consumer rights apply, these Terms operate subject to those rights.
22. Disclaimer
To the extent permitted by law:
Townloop is provided on an “as available” basis
event information may be supplied by independent Hosts
Townloop does not guarantee that all event information is accurate or complete
Townloop does not guarantee that an event meets your expectations
Townloop does not guarantee the conduct of Hosts or attendees
listing an event does not constitute Townloop endorsement of that event.
23. Limitation of Liability
To the maximum extent permitted by law, Townloop and Go Social Industries Pty Ltd are not liable for indirect, incidental, special or consequential loss arising from the use of Townloop.
This includes loss arising from:
event cancellations or changes
inaccurate Host-provided information
interactions with Hosts or attendees
third-party websites or services
temporary platform unavailability.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
24. Host Indemnity
To the extent permitted by law, a Host agrees to indemnify Go Social Industries Pty Ltd against claims, loss or liability arising directly from:
an event organised or published by the Host
content uploaded by the Host
a Host’s breach of these Terms
a Host’s infringement of another person’s rights
unlawful conduct by the Host,
except to the extent that the loss is caused or contributed to by Townloop.
25. Privacy
Townloop handles personal information in accordance with the Townloop Privacy Policy.
The Privacy Policy forms part of the framework governing use of the Services.
26. App Store Platforms
If you obtain Townloop through Apple App Store or Google Play, your use of those distribution platforms is also subject to their applicable terms and conditions.
Townloop remains responsible for the operation of its own Services to the extent required by applicable law and platform requirements.
27. Changes to These Terms
Townloop updates these Terms where its Services, operational practices or legal requirements change.
The current version is published on the Townloop website.
The “Last updated” date identifies the current version.
Continued use of the Services after updated Terms take effect constitutes acceptance of those Terms to the extent permitted by law.
28. Governing Law
These Terms are governed by the laws of Victoria, Australia.
Subject to applicable consumer law, disputes are subject to the jurisdiction of the courts of Victoria and courts entitled to hear appeals from those courts.
